(Scope of Application of the Terms of Use)
Mona Wi-Fi Terms of Service (the "Terms") Ltd. (hereinafter referred to as "the Company"). (hereinafter referred to as the "Service"), which is a telecommunications equipment rental service provided by the Company (hereinafter referred to as the "Company") This applies to everything related to the use of the

(Changes to the Terms of Use)
The Company may change the Terms, including the contents of the Service, without obtaining the consent of the Applicant. If you use the Service after the change, you will be deemed to have accepted the change in these Terms.

(The service area)
The service can be provided only when the terminal equipment connected to the communication line is within the communication area of the agreed operator.
The Subscriber may not claim any compensation for damages due to the inability to communicate with the Company, except in cases caused by the willfulness or gross negligence of the Company.

(Restrictions on the transfer of rights, etc.)
The applicant's right to receive the provision of the Service under these Terms is not transferable.
The Company may terminate the contract if the Applicant violates the preceding paragraph. The Company shall not be responsible for any damage caused to the Applicant as a result of this.

(Contract for the Service)
Application to use the Service (hereinafter referred to as "Application") After agreeing to these terms of use and important explanations in advance, the Company (hereinafter referred to as the "Company") shall fill out the necessary information on the online application screen on the Internet and make an application.
In the Service, the lines and SIM cards of the lending communication equipment and other equipment are designated by the Company. We are unable to respond to any requests or requests for changes made by the applicant or contractor.
When the applicant completes the application for the Service by the procedure specified by the Company, and the Company approves it, the use contract of the Service will be established.
The Company may not approve an application for the Terms of Service under any of the following circumstances In this case, the Company shall notify the Applicant to that effect.
When there is a reasonable reason to believe that there is a risk of the applicant violating this agreement
When there is a risk that the applicant will default on the payment of the debt under this agreement
If the applicant describes a particularly false fact in the application form of this agreement.
When there is a risk of using the Service in a manner that is illegal or clearly offensive to public order and morals
When the applicant is likely to use this service in a manner that is likely to damage the credit of the Company or this service
When the Company judges that the service cannot be provided due to other circumstances
The Company shall be free to terminate the service contract if it is determined that the Company is unable to provide the services desired by the Applicant.

(Cancellation of your application)
If you are unable to use the Service due to out-of-space signal conditions even within the service area provided by a telecommunications carrier or an agreed-upon carrier, the Service will be cancelled if you notify us within 7 days of the date of application.If the SIM card lent by the Company cannot be used on the Subscriber's terminal (non-supporting terminal), the Subscriber shall immediately notify the Company of such failure and return the card to the Subscriber by the method designated by the Company within 7 days including the date of application. Once the Company confirms the return of the card without any communication, only the basic usage fee (administrative fees are not refundable) will be refunded in order.
If more than 8 days have passed since your application, we will not be able to respond to your request for cancellation.

(Delivery of communication equipment)
After the contract is concluded, the applicant can receive the communication equipment and SIM card from us or our designated service provider at the designated place.
The applicant is not allowed to cancel the service contract after the communication equipment is shipped.
In the event of delay or inability to deliver, the Company shall only be responsible for the delivery of the replacement product and shall not be liable for any other responsibility.

(Management of communication equipment, etc.)
The applicant shall maintain and manage the communication equipment, SIM card, etc. with the duty of care of a good manager, and shall be obliged to return the communication equipment, SIM card, etc. to the following places in accordance with the method specified by us after the termination of the contract, regardless of the cancellation or other reasons.
If the Company determines that an Applicant's conduct constitutes a prohibited activity, the Company may recommend that the SIM card, etc. be returned, and the Applicant shall comply with the recommendation.
Any action taken with respect to the SIM card, etc. during the loan shall be deemed to be the action of the Subscriber.
Applicants are prohibited from the following acts when using communication devices and SIM cards. If you violate this, you will be liable for damages and will be subject to termination of the contract.
Transfer, resale, analysis, modification, alteration, damage, destruction, loss, significant defacement (sticker attachment, cutting, coloring, etc.), removal of the attached sticker, etc. of communication equipment, etc.
Unauthorized use outside of these terms and conditions
Acts that fall under the prohibited items described in the instruction manuals for communication equipment, etc.
Acts in violation of the Telecommunications Business Act, the Mobile Phone Misuse Prevention Act, and other related laws and regulations
The applicant shall be obliged to notify us immediately when the communication equipment, SIM card, etc. is lost or damaged or stolen.
If an applicant loses or damages a communication device or SIM card, etc., the applicant shall be obligated to pay the repair cost or the replacement cost of the communication device, etc., unless the reason for the loss or damage is attributable to the Company.
The applicant may use the compensation system separately determined by the Company in preparation for the loss or damage of communication equipment, SIM cards, etc. Please note that MONA Premium is not available for re-subscription after cancellation.

(How to return the item)
The applicant shall use a courier company (LetterPack, NekoPodes, etc.) that has a record of the shipping date to return the communication equipment, SIM card, etc. within 4 days from the date of cancellation of this service, and shall specify the earliest date of arrival and return it. In addition, the applicant shall be responsible for the return shipping costs.
The SIM card, etc. returned by the applicant shall be the SIM card in the same condition (including accessories to match the card size) as when we shipped it to you.
If you do not return the service within 4 days of the cancellation date, you will be charged 30 days' worth of late fees.If you do not return your card by 23:59 on the next settlement date of the cancellation date, you will be charged an additional 30 days' worth of late fees.

(Purchase of communication devices, SIM cards, etc.)
Applicants are not allowed to purchase communication equipment, etc. without the consent of the Company.

(Service Contents)
The contents of the Service provided by the Company shall relate to the matters listed in the following items.
Provision of communications for the Service
Loan of data communication SIM cards or communication equipment necessary for the use of the Service
Alternative SIM card arrangements in case of initial SIM card failure
Other matters related to the preceding items

(Changes in service content)
The Company may change the fees for the Service and the content of the Service without obtaining the consent of the Applicant.

(Device equipment)
The applicant shall prepare the terminal equipment, etc. necessary to use this service at its own responsibility and expense.
Applicant shall maintain the terminal equipment, etc. to conform to the technical specifications prescribed by the Telecommunications Business Law, Radio Law and other related laws and regulations.

(SIM card lending)
The Company will lend the SIM card and accessories to match the size of the plug-in to the subscriber of the Service.
The SIM card we lend you will be a SIM card for data communication only.
The loaned SIM cards include all of the cards that were put together when they were sent, including the standard SIM (U-SIM), microSIM and nanoSIM.
The Company will send the SIM card to the location specified in the shipping information.

(limitation of use)
In order to provide a fair and equitable use of communications, the Company may suspend or restrict the use of communications equipment, etc., in the event that an applicant or user makes excessive communications, as determined by the policies of the providing communications carriers or by the Company.

(Fees and payment methods)
The fee for the Service shall be calculated based on the amount set forth on our website. Rates are subject to change during campaign periods and for large-volume applications.
The applicant shall be obligated to pay the fee for the Service to the Company.
Charges for the Service shall be incurred during the period of use, regardless of whether or not there is actual communication.
The fee expires on the 28th of the previous month, and payment can be made by credit card or in a one-year installment using MONA Coins.
The applicant shall be liable to pay the Company 14.5% per annum of late interest if the fee is not paid by the due date specified by the Company.
The Company may delegate to a third party the act of billing and receiving claims against the Applicant under these Terms.

In the event of a spontaneous failure of the loaned equipment itself, repair shall be carried out without limitation during the contract period, and an alternative shall be loaned in exchange for the equipment concerned.
In case of theft or loss, please report it. Compensation will not be applied in the absence of notification. The loan of substitute goods as compensation is limited to once every two years, and reimbursement is required for the second and subsequent payments within the same period.
MONA Safe is not available for re-subscription after cancellation.

(Compensation for damages)
If the applicant causes damage to the Company due to reasons attributable to the applicant with respect to the use of this service, the applicant shall be obliged to compensate the damage suffered by the Company.
If the applicant causes damage to a third party, or if a dispute arises with a third party regarding the use of this service, the applicant shall settle this at its own responsibility and expense, and shall not make the company bear any responsibility. In the unlikely event that the Company is pursued by another Applicant or a third party for liability, the Applicant shall settle the dispute at its own responsibility and expense, and the Company shall indemnify the Applicant in no way.

(Disclaimer)
1. In the event that the use of the SIM Card, etc. is interfered with, the Company shall not be liable for any failure by the Applicant or the User to contact the Company during the term of use, and the Applicant shall pay the usage fee.
2. The Company shall not be held responsible for any errors in the procedures stipulated in Article 8 (Application Procedures) that may interfere with the use of communication devices, etc., and the Applicant agrees in advance that the Company shall not be held responsible for such errors.
3. The Company shall not be liable to the Subscriber for any accident or damage, etc., suffered by the Subscriber as a result of any hindrance to the use of the communication equipment, regardless of such hindrance.
4. The Company's liability to the Applicant shall be limited to those set forth in these Terms of Use, and beyond this, the Company shall not be liable for any loss of profit, damage related to data loss, etc., or any other damage (whether property damage or non-property damage) suffered by the Applicant in connection with the use of the Service, for any reason whatsoever.

(Termination of this Agreement)
The Company may immediately terminate this Agreement in the event that the Subscriber falls under any of the following
① When you use the Service in a manner that is illegal or clearly offensive to public order and morals
② When the Applicant violates the obligations set forth in these Terms of Use
③ When the applicant filed for bankruptcy, company revival, special liquidation or civil rehabilitation
④ When the Company deems that there are other unavoidable reasons for the cancellation.

Applicants can cancel the service by sending an email through the contact form on our website at least one week in advance.Termination by telephone is not permitted.The deadline for cancellation is the 21st of the previous month. If you cancel after the deadline, you will be charged for the following month.
The applicant can use the SIM card and rental communication equipment, etc. until the 28th of the month of cancellation, but the SIM card and rental communication equipment, etc. must be returned to us by the last day of the month of cancellation at the applicant's expense.Returns must be made by letter pack, cat-post or other traceable means.

(Transfer of these Terms and Conditions)
In the event that the Company transfers the business related to the Service to another company, the Company may transfer the status of the use contract, the rights and obligations under these Terms of Use, the Subscriber's registration information and other customer information to the transferee of the business in conjunction with the transfer of the business, and the Subscriber shall have agreed in advance to such transfer in this section.The transfer of business as set forth in this paragraph shall include not only ordinary transfer of business but also any case in which the business is transferred, such as a company split or any other transfer of business.

(Protection of personal information)
In accordance with the provisions of the Act on the Protection of Personal Information, the Company will properly manage the personal information of applicants with the care of a good manager.
The Company will use the applicant's personal information for the purpose of providing services (such as providing information on products and services, conducting surveys, etc.), billing or providing information on services in our group, and will not use it for any other purpose.
The applicant is required to register as a member in order to use the Service. To members, individually or collectively if necessary, you may be contacted by the notification method (such as mail, telephone, email, etc.) provided by the Company to the registered contacts.

(Governing Law and Jurisdiction)
These Terms of Use shall be governed by and construed in accordance with the laws of Japan. The Nagoya District Court shall be the exclusive jurisdictional court of first instance in the case of any dispute relating to these Terms of Use or this Agreement.

 

Supplementary provisions
These terms and conditions are effective April 4, 2018.
